Oh I am sure they will release him. But not until after they give him a couple days of electro shock treatments, some mind altering drugs, and he no longer can remember his own name. Then they will drop him off on a street corner in downtown Oakland in nothing but his underwear at 3:00 AM. But they won't detain any longer than that.
