lol, yep, i think...
its fermented and has alcohol but i think it can be sold just like any tea/soda... less than 1% i think...

I would say YES but it's probably not going to have the desired effect... 
It's only mildly caffeinated and very low ABV% , it's supposed to be some kind of health elixir. A st louis couple was just on the news and are mass brewing it, and can't keep up with the orders.
